All terms are legally binding and must be followed to avoid any legal mitigation due to illegal use of the material you purchase from our store.
You agree to these terms upon purchase whether you read them or not. Terms are subject to change at any time.
| General Terms |
- All Material on this site is Copyright Elaborique Designs. Elaborique Designs retains the copyright of all materials. When you purchase from us you are ONLY purchasing the rights to DISPLAY our material, all credits must remain intact.
- Due to the Nature of our Services we do not offer refunds.
- Once a product has been customized and delivered to you we consider the order closed. There will be no other changes made to it without additional charges.
- Nothing in our store is public domain, there for you must purchase all items, in order to use them.

| What You Can and Can't Do |
- All items must be used for their intended purpose. (A Template may not be used for a store front, a Blog Design may not be used for a store header etc.)
- A Copyright notice must remain on the bottom of all our work. If you remove this copyright your license to use will be cancelled without notice. And we will take the appropriate action need to have our design removed.
- You may not alter, change or use the graphics or products you purchase.
- You many not change our backgrounds on our templates even if you keep the copyright notice on the template.
- You may not resell or give away any products you products you purchase from us
- All Graphics and Designs may not be modified or distributed by any means, either electronic or print. There are NO exceptions to this rule!
- If you hire someone other than me to do your Search Engine Optimization, and in turn your template code is changed or lost I will charge full price to redo your coding. The systems we use for SEO works perfectly with the original codes you have and should not need any modification at all. If you come across a SEO Expert that says otherwise, I suggest you look elsewhere for SEO help, as they are not being honest!

| Violations of Terms |
- Persons found to be altering or using our codes or materials will be asked to remove the items. If we feel its necessary we will take the legal actions necessary to have you cease using our items, and will claim all profits due us for the use of said material.
- In addition we will also contact the auction site, or web site host where the material is being use and ask them to remove it.
- We are a member of Vero, and will immediately ask eBay to end all auctions, close all stores that violate our terms.

| Our Graphics |
- Our hand drawn images remain the copyright of Elaborique Designs. Just because you purchase a hand drawn design does not release its copyright to you. You are only purchasing the rights to display them. All terms still apply to hand drawn images.
- You have the option to purchase a limited Copyright Release for your design contact us for more information.
- Often we will use Royalty-Free images in your designs. These are licensed and permitted to be used by us. We can not guarantee that you will never see these images elsewhere on the web, but we will never sell them again.

| Design Process |
- You agree that we will re create the design a total of 3 times according to what you have asked for. After the 3rd time you will have to pay full price to have a redesign done. (this is meant for full recreations, not adjustments to the current design)
- You agree that after you have approved an element of the design we consider it completed and any adjustments will be provided at our hourly rate only.
- Most of our correspondence will be through email. We will need to you answer our emails in order to complete your order. If after 30 days we do not hear from you regarding your design, we will consider the project closed. In order to re-open the design you will have to pay any differences in current prices to the one you paid.
- Each item gives a detailed list as to what we provide you, if you are wanting anything extra there will be additional charges, please email us for more information.
